These Terms of Service ("Terms") govern your use of the PracticeSmart marketing website at practicesmart.com.au(the "Site"), operated by The Mind Body Practice Pty Ltd(ABN 22 631 025 440), trading as PracticeSmart ("we", "us", "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. What the Site provides

The Site provides:

  • Information about PracticeSmart products and services for Australian allied health professionals.
  • The ability to subscribe to our email mailing list for product updates, resources, and marketing communications.
  • Downloadable resources such as guides and cheat sheets.

The Site does not provide clinical advice, therapeutic services, or patient management functionality.

When you subscribe to our mailing list, you consent to receiving marketing emails from PracticeSmart. You may unsubscribe at any time by:

4. Intellectual property

All content on the Site — including text, graphics, logos, images, software, and downloadable resources — is the property of The Mind Body Practice Pty Ltd or its licensors and is protected by Australian and international intellectual property laws.

You may view, download, and print content from the Site for your personal, non-commercial use. You must not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.

The names "PracticeSmart", "ClaimSmart", "ComplianceSmart", "MatchSmart", and "CPDSmart" are trademarks of The Mind Body Practice Pty Ltd.

  • Use the Site for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorised access to any part of the Site or its infrastructure.

PracticeSmart is a practice management tool. Nothing on the Site constitutes clinical, medical, legal, or financial advice.

7. Limitation of liability

To the maximum extent permitted by law, The Mind Body Practice Pty Ltd, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site.

Our total liability for any claim arising from your use of the Site is limited to the amount you have paid to us in the 12 months preceding the claim, or AUD $100, whichever is greater.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth) (Schedule 2 — Australian Consumer Law) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

If our goods or services come with guarantees that cannot be excluded under the Australian Consumer Law, we limit our liability (where permitted) to the resupply of the services or the payment of the cost of having the services resupplied.
